Terms of Service

Welcome to CleanTruckPro ("CleanTruckPro," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the CleanTruckPro software platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

CleanTruckPro is a software platform that helps vehicle inspection, fleet service, and trucking businesses ("Business," "you," or "your") manage customers, vehicles, invoicing, scheduling reminders, document storage, and payment collection.

CleanTruckPro is a software provider. We are not a party to the underlying transactions between you and your customers. We do not inspect vehicles, perform services, or guarantee the accuracy of any data you enter into the Service.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, including activity by any additional users (such as employees) you grant access to.

You must notify us promptly of any unauthorized use of your account.

3. Payment Processing

CleanTruckPro uses Stripe, Inc. ("Stripe") to facilitate payment processing, including Stripe Connect for routing payments from your customers directly to your own connected Stripe account. By using the payment features of the Service, you agree to Stripe's Connected Account Agreement and Stripe's Terms of Service, available at https://stripe.com/legal.

CleanTruckPro does not hold, custody, or have access to funds processed through Stripe. We are not responsible for delays, failures, chargebacks, fraud, or disputes related to payment processing. Any such issues are between you, your customer, and Stripe.

You are solely responsible for setting accurate prices, issuing refunds, and complying with applicable tax obligations related to payments you collect.

4. Your Data and Customer Data

You retain ownership of the data you input into the Service, including your customer records, vehicle records, invoices, and any documents you upload ("Your Data").

You are solely responsible for:

• The accuracy of Your Data
• Obtaining any necessary consent from your customers to store and process their information
• Complying with applicable privacy and data protection laws regarding your customers' information

We store Your Data using third-party infrastructure providers (including Supabase and its underlying cloud hosting) and take reasonable measures to protect it, but we do not guarantee uninterrupted or error-free storage.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Store or transmit fraudulent, deceptive, or harmful content
• Attempt to gain unauthorized access to the Service or other users' data
• Use the Service to process payments for any purpose other than legitimate goods or services you provide

6. Fees

Use of the Service may require payment of subscription fees as described at signup or in your account settings. Fees are non-refundable except as required by law or as we expressly state otherwise. We may change our fees with advance notice.

7. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice where practicable.

Upon termination, your right to use the Service ends immediately. We may retain or delete Your Data in accordance with our data retention practices and applicable law.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEANTRUCKPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold CleanTruckPro harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including your customers.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the Service or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless otherwise required by applicable law.
